In their opening statement Friday, prosecutors said investigators found more than 100,000 messages that Flynn sent to his mistress a year before Ashley’s death.
Prosecutors say Caleb wrote in one message, “Trying to think of ways to kill her and not go to jail,” adding that he would kill Ashley “in a heartbeat” if he could do it without going to hell.
The night before Ashley’s murder, Caleb sent messages to his mistress; In one message he wrote, “I choose you. I am free. The action will take place tomorrow, February 16, a day I will never forget.”
Prosecutors accused Caleb of staging a murder scene that looked like a burglary. Ashley was shot in the back of the head as she lay in her bed.
While prosecutors cited the text messages in their case, defense attorneys denied the allegations. The defense argues that there is no direct forensic evidence linking Caleb to the murder. The defense said investigators put pressure on Caleb after they discovered his alleged affair.
Caleb has pleaded not guilty at trial for murder.
